Based on the broad policy options laid down in the 2017 Inception Impact Assessment and the detailed individual policy measures on which stakeholders were consulted in 2019, the EC presented a high-level draft list of policy options that are analysed in the context of a possible revision of the Airport Charges Directive.

During the first discussion session that was open to all attendees, the Commission presented the policy options that are analysed in the context of a possible revision of the Airport Charges Directive. Apart from the baseline scenario which foresees no change to the directive currently in force, there are four options on the table. Option A would look for clarifications of: requirements on both airports and airlines relating to the consultation process and the transparency requirements linked to it; the provisions relating to non-discrimination and the independence, setup, role and duties of ISAs. Option B would prescribe incentive regulation in the form of a price cap (a cap of the total revenues per passenger that the airport may collect) as a fall-back form of airport charges regulation for all airports within the legal scope of the current ACD. Under  option C there are three different scenarios analysed, each would require ISAs to perform a market power assessment on airports. Option D would be repeal of the directive and reliance on EU competition law only (but member states would remain free to retain or introduce further regulatory measures).

A new environmental objective with the obligation to modulate airport charges to minimise the impact of airport operations on the environment would be part of all possible options analysed (A to C). Environmental aspects would be also taken into account with regard to new investment.

Based on the co-ordination before the workshop, airline representatives were aligned that options A and D are not supported but further analysis is needed regarding the preferred way forward.
